We recently acted on the acquisition of an industrial system which involved the assignment of copyright, confidential information and trade marks. It was important to our client to ensure that it owned the name of the system which was well known in the industry. We negotiated the sale and purchase agreement and ensured that the system’s name was transferred to our client and protected by way of a trade mark.

We advised a client on a “cease and desist” letter it had received from a multinational corporation alleging that our client was infringing the multinational’s registered trade mark by using a trading name which was identical to its registered trade mark. The trading name was key to our client as it had built up a significant reputation using that name. We negotiated a co-existence agreement, which permitted our client and the multinational corporation to use the name in each of its distinctive industries, and we also dealt with a subsequent trade mark registration to ensure our client’s trading name was protected.
